We Respect Intellectual Property

Mode IPTV respects the intellectual property rights of content owners and expects the same from the third-party suppliers whose services we resell. We comply with the U.S. Digital Millennium Copyright Act (DMCA) and Canada’s Notice and Notice regime under the Copyright Act, and we respond promptly to every valid infringement notice we receive.

Mode IPTV is an independent reseller of third-party streaming services. We do not host, store, upload or transmit any video content on our servers, and we are not affiliated with, endorsed by, or sponsored by any television network, broadcaster, studio or sports league. All streams are provided and controlled by independent third-party suppliers. When we receive a valid notice concerning content accessible through a service we resell, we forward it to the relevant supplier and take any action available to us.

Filing a DMCA Notice

To file a copyright infringement notice, email us at dmca@modeiptv.ca with “DMCA Notice” in the subject line. For your notice to be valid, it must include all of the following:

  1. Your full legal name, email address, telephone number and physical address;
  2. Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works are covered by one notice);
  3. Identification of the material you claim is infringing, with enough detail for us to locate it — URLs, channel names, content titles, dates and times observed;
  4. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
  5. A statement that the information in your notice is accurate, and — under penalty of perjury — that you are the copyright owner or authorized to act on the owner’s behalf;
  6. Your physical or electronic signature.

Incomplete notices may be rejected or delayed while we request the missing information.

Our Response — Within 24 Hours

We review every complete notice within 24 hours of receipt. If the notice is valid, we will forward it to the third-party supplier responsible for the content, take whatever remedial action is available to us as a reseller, and confirm to you by email what was done. Where Canadian law applies, we handle notices in accordance with the Notice and Notice provisions of the Copyright Act.

Accounts of subscribers who are determined to be repeat infringers of intellectual property rights will be terminated.

Misrepresentation

Under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees. If you are unsure whether material infringes your copyright, we recommend consulting a lawyer before submitting a notice.

Counter-Notice

If you believe material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to the same address, dmca@modeiptv.ca, with “DMCA Counter-Notice” in the subject line. It must include:

  1. Your name, address, telephone number and email address;
  2. Identification of the material that was removed and its location before removal;
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
  4. Your consent to the jurisdiction of the courts of your place of residence (for Canadian residents, the courts of your province; for others, the applicable federal court);
  5. Your physical or electronic signature.
